1. Agreement

We provide civil, structural, and architectural engineering support, steel detailing, shop drawings, BIM modeling, and related drafting services to fabricators, contractors, and engineers in the United States. Specific scope, deliverables, schedules, and fees are defined only in a written proposal, statement of work, or contract signed by both parties.

3. Website use

• Content on this site (text, graphics, logos, technical descriptions) is owned by Total Engineering Consultants LLC or its licensors and may not be copied or redistributed without permission.
• Information on the site is for general marketing and educational purposes and is not professional engineering advice for a specific project unless provided under a signed agreement.

4. Quotes and proposals

Online forms, email requests, and verbal discussions do not create a binding contract until a formal proposal or agreement is accepted in writing. We reserve the right to decline projects that fall outside our scope, capacity, or licensing requirements.

5. Client responsibilities

• Provide accurate design documents, loads, codes, and project criteria timely
• Review deliverables and return consolidated comments within agreed review periods
• Maintain backups of your original files and approved revisions
• Ensure you have rights to share all materials submitted to us

6. Intellectual property

Upon full payment for a defined scope, deliverables specified in your contract are licensed to you for the project as stated in that agreement. We retain rights to generic know-how, templates, and non-project-specific tools. Unless otherwise agreed, we may list completed project types without confidential details.

7. Professional standards

Work is performed in accordance with applicable codes and standards referenced in your contract (e.g., AISC, ACI, ASCE, OSHA) and the information you supply. Final responsibility for design approval, permitting, and field use of documents remains with the Engineer of Record or your licensed professional unless we are explicitly engaged and identified as the responsible engineer in writing.

8. Limitation of liability

To the fullest extent permitted by law, Total Engineering Consultants LLC is not liable for indirect, incidental, or consequential damages arising from use of the website or services. Our total liability for any claim related to a specific project is limited to the fees paid for that project under the governing contract, except where prohibited by law.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising from inaccurate information you provide, misuse of deliverables, or violation of these terms, except to the extent caused by our gross negligence or willful misconduct.

10. Governing law

These terms are governed by the laws of the State of Minnesota, USA, without regard to conflict-of-law principles. Disputes shall be resolved in courts located in Minnesota, unless otherwise specified in a signed project agreement.

11. Changes

We may revise these Terms of Service at any time by posting an updated version on this page. Material changes apply from the date posted unless otherwise stated.
